PepsiCo is being sued for an alleged incident involving a mouse found in a Mountain Dew can, and it just revealed an interesting defense (via HuffPo).
Plaintiff Ronald Ball wants upwards of $50,000 from Pepsi. He claims in the lawsuit that after he found the mouse, he sent it in to Pepsi, who then destroyed its body.
Now, Pepsi says that the guy's story can't be true, because if there really was a mouse's dead body inside the can, it would have transformed into a "jelly-like" substance, reports LegalNewsline.
Eww.
It seems strange, but consider an incident from back in 2009 when a guy took a gulp out of a Diet Pepsi can and found a disgusting blob. It turned out to be either a frog or toad, according to the FDA.
Either way, it's pretty concerning. It's not going to make anyone feel better about consuming the drink, especially after reports in December that Mountain Dew (among other sodas) has BVO in it, a patented flame retardant
